4 Requirements for a Valid DMCA Notice
To be valid, your DMCA takedown notice must include all of the following elements as required by 17 U.S.C. § 512(c)(3):
- 1A physical or electronic signature of the copyright owner or person authorised to act on their behalf.
- 2Identification of the copyrighted work claimed to have been infringed. If multiple works are covered, a representative list is acceptable.
- 3Identification of the infringing material — a specific description of where the content is located within our service (e.g. channel name, stream URL, or VOD title).
- 4Your contact information — name, address, telephone number, and email address.
- 5A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- 6A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorised to act on the copyright owner's behalf.
Notices that do not include all required elements may not be acted upon. We recommend consulting a legal professional if you are unsure about the process.
5 Takedown Process
Upon receipt of a complete and valid DMCA notice, we will follow this process:
Receipt & Verification
We acknowledge receipt of the notice and verify that all required elements are present. Incomplete notices will be returned for correction.
Content Review
Our team reviews the identified content to assess the claim. We aim to complete this review within 48–72 hours of receiving a valid notice.
Removal or Disabling
If the claim is substantiated, we will remove or disable access to the identified content promptly.
User Notification
Where applicable, the affected user will be notified of the takedown and their right to submit a counter-notice.
Confirmation to Claimant
We will confirm to the copyright owner that the content has been addressed.
6 Counter-Notice Procedure
If you believe that content was removed from our Service as a result of a mistake or misidentification, you may submit a counter-notice. A valid counter-notice must include:
- Your physical or electronic signature
- Identification of the content that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the courts in your district
7 Repeat Infringer Policy
In accordance with the DMCA and our commitment to copyright compliance, StreamUK Pro maintains a policy of terminating accounts of users who are found to be repeat infringers of intellectual property rights.
An account may be terminated if the user is subject to two or more valid DMCA notices within any 12-month period. Terminated accounts will not receive a refund for any remaining subscription period.
8 Misuse & False Claims
StreamUK Pro takes the misuse of the DMCA process seriously. Submitting a notice containing materially false information may expose you to civil and criminal liability under 17 U.S.C. § 512(f), including:
- Liability for damages suffered by the alleged infringer
- Liability for costs and attorney's fees
- Potential criminal prosecution for knowing misrepresentation
We reserve the right to pursue legal remedies against any party who abuses the DMCA takedown process in bad faith.
